TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of www.gymxapparel.in, www.gymxapparel.com and www.gymx.co.in (collectively, the “Website”), operated by GymX Merchandise LLP (“GymX”, “Company”, “we”, “us”, “our”).

By accessing or placing an order through our Website, WhatsApp, official email, Meta pages, or any official digital channel owned by GymX, you agree to be bound by these Terms, along with our Privacy Policy and Refund & Exchange Policy.

If you do not agree, please do not use our services.

1. Eligibility

By placing an order, you confirm that:

  • You are legally competent to enter into a contract under Indian law

  • All information provided by you is accurate and complete

2. Orders & Acceptance

  • All orders are subject to acceptance and availability.

  • GymX reserves the right to cancel or refuse any order at its discretion.

  • In case a product becomes unavailable after payment, we may offer exchange, store credit, or refund as applicable.

3. Pricing & Payments

  • Prices are listed in INR and inclusive of applicable taxes unless stated otherwise.

  • Payments are processed securely via third-party gateways such as Razorpay.

  • GymX does not store complete card or banking details.

  • For COD orders, additional charges may apply.

Payments must be made only to accounts in the name of GymX Merchandise LLP. We are not responsible for payments made to unauthorized accounts.

4. Exchange Policy

GymX primarily offers exchange or store credit, subject to the following:

  • Exchange requests must be initiated within 7 days of delivery.

  • Product must be unused, unwashed, and in original condition with tags.

  • Reverse pickup charges of Rs.150 apply (if serviceable).

  • If reverse pickup is unavailable, customer must self-ship the product.

  • Courier charges are non-refundable.

  • Exchange is allowed only once per order.

  • Sale items may not be eligible for exchange.

If the requested size or product is unavailable, customer may:

  • Choose another product of equal value

  • Pay the difference (if higher value)

  • Receive store credit (if lower value)

Store credit is valid for the period mentioned in the Refund Policy.

5. Refund Policy

  • Refunds, where applicable, may be issued as store credit unless otherwise required under applicable law.

  • If cancellation is requested before dispatch, the customer may be eligible for a refund to the original payment method or store credit, subject to applicable payment gateway charges and company policy.

  • In case of prepaid orders where product is unavailable, refund may be processed to original payment method or store credit at our discretion.

Nothing in this clause limits your statutory rights under applicable consumer laws.

6. Damaged / Incorrect Products

If you receive a defective, damaged, or incorrect product:

GymX will investigate and, if valid, arrange replacement or appropriate resolution.

7. Shipping & Delivery

  • Delivery timelines are estimates and may vary depending on location.

  • Once dispatched, risk transfers to the customer upon delivery.

  • Customer must ensure accurate shipping details.

  • If tracking shows “delivered,” customer must notify us within 24 hours if not received.

8. Product Disclaimer

  • Due to lighting, photography, and screen differences, slight color variation may occur.

  • Minor size variation may occur due to manufacturing tolerances.

9. Bulk / B2B / Custom Orders

  • Bulk, wholesale, or customized orders require full advance payment.

  • Such orders may not be eligible for exchange or refund unless defective.

10. Intellectual Property

All content including:

  • Images

  • Designs

  • Logos

  • Graphics

  • Product descriptions

are the intellectual property of GymX Merchandise LLP.

Unauthorized reproduction, copying, or commercial use is prohibited.

11. Limitation of Liability

To the maximum extent permitted under Indian law:

  • GymX shall not be liable for indirect, incidental, or consequential damages.

  • Our total liability shall not exceed the amount paid for the product in dispute.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify GymX against claims arising from:

  • Misuse of the Website

  • Breach of these Terms

  • Fraudulent or unlawful activity by you

This clause does not require you to pay unrelated legal costs.

13. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

14. Changes to Terms

GymX reserves the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date.

Continued use of the Website constitutes acceptance of revised Terms.
